Mit dem Entwurf eines Landesglücksspielgesetzes will die Landesregierung den Ersten Glücksspieländerungsstaatsvertrag, der zum 1. Juli 2012 in Kraft getreten ist, ergänzen und konkretisieren. Darin werden neben allgemeinen Ausführungsbestimmungen auch Regelungen zu den Spielhallen, die landesgesetzlichen Regelungen zum Rennwett- und Lotteriegesetz sowie die Vorschriften zu den Spielbanken aufgenommen. „Damit haben wir ein Gesamtpaket geschnürt, das einen vernünftigen Ausgleich zwischen Suchtprävention und Gewerbefreiheit bietet“, unterstrichen Ministerpräsident Winfried Kretschmann und Innenminister Reinhold Gall im Anschluss an die Sitzung des Ministerrats in Stuttgart. Der Entwurf gehe jetzt in die Anhörung, das Gesetz solle noch dieses Jahr in Kraft treten, damit endlich Rechtsklarheit herrsche.
Das Gesetz habe sämtliche Ziele, die durch den Ersten Glücksspieländerungsstaatsvertrag vorgegeben werden, im Blick. Es soll den Jugend- und Spielerschutz besonders berücksichtigen, kanalisierende Wirkung für Glücksspielwillige haben, einen Baustein zur Bekämpfung des Schwarzmarktes bilden und die Integrität des Sports schaffen. Den Städten und Gemeinden gebe es ein Mittel an die Hand, um den Wildwuchs bei den Spielhallen einzudämmen. Gleichzeitig biete es durch Übergangsvorschriften und Härtefallregeln den Gewerbetreibenden genügend Zeit, sich den neuen Gegebenheiten anzupassen.
Neben den Regeln zum Verfahren und den Voraussetzungen, unter denen eine glücksspielrechtliche Erlaubnis erteilt werden dürfe, würden spezielle Regelungen für die einzelnen Glücksspielarten getroffen. Wesentliche Neuerungen gegenüber der bisherigen Rechtslage seien:
Die Anzahl der Lotto-Annahmestellen wird festgeschrieben. Erstmals sind darüber hinaus private Wettvermittlungsstellen der Konzessionsnehmer für Sportwetten bis zu einer Höchstgrenze von 600 Stellen für ganz Baden-Württemberg zulässig.
Nachdem die Gesetzgebungskompetenz für Spielhallen auf das Land übergangen ist, können jetzt die gewerbe- und glücksspielrechtlichen Zulassungsvoraussetzungen für den Betrieb einer Spielhalle in einem Verfahren gebündelt werden. Insbesondere sind Spielhallen künftig nicht erlaubt, wenn sie im baulichen Verbund mit weiteren Spielhallen stehen oder keinen Mindestabstand von 500 Metern zu weiteren Spielhallen oder Einrichtungen zum Aufenthalt von Kindern oder Jugendlichen einhalten.
Auch die Ausgestaltung der Werbung wird reglementiert. Weiterhin sind Einlasskontrollen und Sperrdateiabgleiche sowie feste Regelungen zu den Sperrzeiten vorgesehen. Wie alle übrigen Betreiber von Glücksspieleinrichtungen sind künftig auch die Spielhallenbetreiber verpflichtet, zum Schutz der Spielwilligen ein Sozialkonzept zu entwickeln und ihre Mitarbeiterinnen und Mitarbeiter entsprechend zu schulen.
